These Terms of Use apply when you use services offered by Nixtla, Inc. or its affiliates (“Services”). This includes application programming interfaces (APIs), software, tools, developer services, data, documentation, and websites. The Terms also include all documentation, guidelines, or policies provided by Nixtla in writing. By using the Services, you agree to these Terms.

Key Concept 1: Minimum Age

Users must be at least 13 years old to use the Services. If under 18, a parent or legal guardian must give permission.

You own your Input, and Nixtla assigns you the rights to your Output. Follow applicable laws and these Terms when using Content.

2. Usage Requirements

Please review these usage requirements carefully to avoid violating our policies.

(a) Use of Services
You may access the Services under a non-exclusive right consistent with these Terms. Nixtla and its affiliates retain all rights, title, and interest in the Services, and you must comply with all applicable laws.

(b) Feedback
We welcome and appreciate any feedback, comments, ideas, proposals, and suggestions. By providing feedback, you grant Nixtla permission to use it without restriction or compensation.

(c) Restrictions

Failure to follow these restrictions may result in account suspension or termination.

  • (i) Do not use the Services in any way that violates others’ rights.
  • (ii) Do not reverse engineer or attempt to discover source code of our models or systems (unless explicitly permitted by law).
  • (iii) Do not use outputs from our Services to develop competing models.
  • (iv) Do not extract data or outputs using scraping or similar automated methods (unless explicitly allowed through the API).
  • (v) Do not misrepresent output as human-generated.
  • (vi) Do not buy, sell, or transfer API keys without written consent.
  • (vii) Do not provide personal information of children under 13 or below the applicable age of consent.

You must also follow rate limits and technical guidelines described in our documentation and use the Services only in geographies supported by Nixtla.

(d) Third-Party Services
Any third-party products or services used alongside Nixtla Services are subject to their own terms, and Nixtla is not responsible for them.

(a) Your Content
”Input” refers to data you provide to the Services, and “Output” refers to the generated output. Collectively, both are “Content.”

• You own your Input to the extent allowed by law.
• Subject to compliance with these Terms, Nixtla assigns you all rights to your Output.
• You may use your Content for personal or commercial purposes as long as you comply with the Terms.

Nixtla may process your Content to provide and maintain the Services, ensure legal compliance, and enforce our policies. You are responsible for ensuring your Content is lawful and follows these Terms.

(b) Use of Content to Improve Services

To opt out of having your Content used for service improvements, please complete this form.

Nixtla may use aggregated and de-identified data from your Content to enhance and operate Services. This can include benchmarking and forming best-practice resources.

(c) Accuracy
AI and machine learning models can have limitations. Evaluate the accuracy of any Output you receive, and consider applying appropriate human review measures.
